These Website Terms and Conditions (the “Terms”) govern access to and use of the Hometown Roofing & Restoration websites, landing pages, forms, online content, and related online services.

By accessing or using the website, you agree to these Terms to the extent permitted by law. Separate written agreements govern construction, mitigation, restoration, financing, warranties, and other paid services.

1. Website Purpose

The website provides general information about Hometown, roofing and restoration services, inspections, mitigation, referral programs, and methods of contacting the company.

Website content does not by itself create a contractor-customer relationship, guarantee acceptance of a project, or constitute a binding scope of work, estimate, warranty, proposal, or contract.

2. Estimates, Proposals, and Services

Pricing, service descriptions, project examples, timeframes, estimate information, and general guidance displayed online are subject to inspection, verification, availability, site conditions, written proposal terms, and an executed agreement.

A binding obligation to perform work arises only through an authorized written agreement or another legally enforceable arrangement.

3. Insurance and Public Adjusting Disclaimer

Any website content concerning storm damage, insurance, restoration, or insurance-related work is general information and is not legal, insurance, public-adjusting, or coverage advice.

Hometown does not guarantee insurance coverage, claim approval, insurer payment, claim amount, or reimbursement.

Hometown is a contractor and does not act as a public insurance adjuster.

Hometown does not negotiate insurance claims, interpret insurance policies or coverage, advise a policyholder concerning claim settlement, or represent a policyholder in communications with an insurance company.

Customers should direct coverage and claim questions to their insurer, licensed insurance professional, attorney, or licensed public adjuster, as appropriate.

4. Insurance Deductibles

Hometown does not waive, pay, reimburse, credit, absorb, or otherwise improperly offset property-insurance deductibles.

Promotional incentives and referral rewards are separate from a customer's insurance obligations, cannot be applied to a Hometown invoice, and may not be represented as deductible credits or waivers.

Customers remain responsible for deductibles required by their policies and applicable law.

5. Referral Program

Participation in the Hometown Referral Program is governed by the separate Referral Program Terms.

If these Website Terms conflict with the Referral Program Terms concerning referral eligibility, qualification milestones, or rewards, the Referral Program Terms control.

6. Electronic Communications and Marketing Choices

Submitting an inquiry authorizes Hometown to respond to that inquiry using the contact information provided.

It does not automatically authorize recurring automated marketing.

Marketing emails, automated text messages, prerecorded or artificial-voice marketing calls, and AI-generated marketing calls will be sent only as permitted by law and subject to applicable consent requirements.

Marketing consent is voluntary.

Where a form includes a marketing-consent option, consent must be provided directly by the person to be contacted and is not a condition of purchasing goods or services.

A person may unsubscribe from marketing emails, reply STOP to supported text messages, or contact Hometown to revoke marketing consent.

Transactional or service communications may continue when reasonably necessary to provide requested or contracted services.

7. Permitted Use

The website may be used only for lawful purposes.

Users may not:

  • Attempt unauthorized access to websites, accounts, servers, systems, or data.
  • Interfere with website operation, performance, availability, or security.
  • Submit false, fraudulent, deceptive, abusive, or misleading information.
  • Impersonate another person or misrepresent authority to act for another person.
  • Misuse forms, referral systems, communication tools, or contact information.
  • Introduce malicious code or use automated tools in a manner that harms, overloads, or extracts protected content from the website.
  • Copy, reproduce, distribute, modify, or commercially exploit website content in violation of applicable law or intellectual-property rights.

8. Intellectual Property

A person submitting information represents that the information is accurate to the best of that person's knowledge and that the person has the authority or permission necessary to submit it.

A user must not submit confidential, copyrighted, or personal information belonging to another person without appropriate permission.

Submission of an inquiry, referral, photograph, review, testimonial, or other material does not automatically grant Hometown permission to use a person's name, likeness, property image, review, or testimonial in advertising.

Hometown will obtain a separate authorization or release when required before using those materials for marketing.

10. Reviews, Testimonials, and Endorsements

Reviews and testimonials must reflect the speaker's honest experience and may not contain claims the speaker does not reasonably believe to be true.

If a person receives or may receive a reward, discount, free service, or other benefit connected to a public recommendation, that relationship must be clearly and conspicuously disclosed with the recommendation.

11. Third-Party Services and Links

The website may contain links to or functionality provided by third-party websites and services.

Those services are governed by their own terms and privacy practices.

Hometown does not control and is not responsible for independent third-party content, availability, security, or privacy practices except as required by law.

12. Website Availability and Accuracy

Hometown makes reasonable efforts to maintain accurate and useful website information but does not warrant that the website will be uninterrupted, error-free, completely secure, or free from outdated, incomplete, or inaccurate content.

Hometown may correct errors and change, remove, suspend, or update website content or functionality.

13. Disclaimer of Website Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED.

This website disclaimer does not modify warranties or obligations expressly provided in a signed customer agreement.

14. Limitation of Website Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMETOWN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF, OR INABILITY TO USE, THE WEBSITE OR GENERAL WEBSITE CONTENT.

This limitation does not apply to liability that cannot legally be limited or to obligations expressly provided in a signed customer agreement.

15. Responsibility for Unlawful Misuse

To the extent permitted by law, a user is responsible for losses or claims directly resulting from the user's unlawful misuse of the website, fraudulent submissions, infringement of third-party rights, or material violation of these Terms.

16. Privacy

Hometown's Privacy Policy describes how personal information is collected, used, disclosed, retained, and protected.

The Privacy Policy is incorporated by reference for purposes of describing Hometown's data practices.

17. Accessibility

Hometown seeks to provide a website that is reasonably accessible.

18. Changes to These Terms

Hometown may update these Terms from time to time.

The version posted with the applicable Effective Date or Last Updated date will govern website use after the change, to the extent permitted by law.

Material changes will not retroactively alter an executed customer agreement unless that agreement expressly permits the change.

19. Severability and No Waiver

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

Hometown's failure to enforce a provision does not waive that provision or any other provision.

20. Governing Law

These Terms are governed by Texas law, without regard to conflict-of-law principles, except where another law must apply.

Nothing in these Terms limits rights or remedies that cannot legally be limited.
